1. Ordering & Payment
Service: Orders placed via this website are for in-store pickup only.
Platform: This ordering system is powered by Review Pulse. You acknowledge that Review Pulse facilitates the payment and order transmission but is not responsible for food preparation, quality, or kitchen operations.
Payments: Payments are processed securely via Stripe. By placing an order, you agree to Stripe’s terms. Neither Top Thai Takeaway nor Review Pulse store full credit card details on local servers.
2. Delivery via Uber Eats
Top Thai Takeaway does not manage or control delivery services. All delivery is handled exclusively by Uber Eats.
We are not responsible for delays, missing items, food condition, or the conduct of drivers.
All delivery-related complaints and refund requests must be directed to Uber Eats via their app or website.
3. Menu, Allergens & Dietary Requirements
We aim to keep our menu accurate, but items and ingredients may change without notice.
Allergy Warning: Our kitchen handles peanuts, shellfish, gluten, and other allergens. You must inform us of any allergies before ordering.
To the extent permitted by law, we are not liable for allergic reactions where a customer has not pre-disclosed a requirement or where cross-contamination occurs despite our best efforts.
4. Australian Consumer Law, Refunds & Cancellations
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).
Major Failures: If your order has a major failure (e.g., inedible or unsafe), you are entitled to a replacement or a full refund.
Minor Failures: For minor issues (e.g., missing condiment), we will rectify the problem at our discretion.
Cancellations: As food is prepared fresh, cancellations must be made via phone immediately. We cannot guarantee a refund once food preparation has commenced.
5. Right to Refuse Service
We strive to provide a high-quality experience for all customers. However, we reserve the right to refuse service, cancel orders, or block access to this platform for:
Anyone engaging in abusive, threatening, or unlawful behavior toward staff or via the platform.
Repeated Dissatisfaction: Where a customer has repeatedly expressed dissatisfaction with our products, ingredients, or service standards that we are unable or unwilling to change. In such cases, we may decline future orders to avoid further disappointment.
6. Intellectual Property
All content on this website - including images, branding, and layout - is the property of Top Thai Takeaway and Review Pulse. It may not be reproduced without express permission.
7. Indemnity & Limitation of Liability
Indemnity: You agree to indemnify and hold harmless Top Thai Takeaway and Review Pulse, including their owners and staff, from any claim, loss, or expense arising from your use of this website or the consumption of our products, except where such loss is caused by our gross negligence.
Liability: To the maximum extent permitted by law, our liability is limited to the value of the order placed. We are not liable for any indirect or consequential loss.
